These terms are the agreement between your business and us when you use Ratezing. We've written them in plain English. Please read them, especially the sections on asking for reviews honestly and on payments.
Who we are
Ratezing is run by Ratezing, LLC, a company registered in Wyoming, USA. "We", "us" and "Ratezing" mean Ratezing, LLC. "You" means the business or organisation that uses Ratezing, and anyone who uses it on the business's behalf.
Questions: [email protected]. Privacy questions: [email protected].
Agreeing to these terms
By creating an account or using Ratezing, you agree to these terms and to our Privacy Policy. If you sign up for a business, you confirm that you're allowed to agree on its behalf.
Ratezing is for businesses, not for personal use, and you must be at least 18 to sign up.
What Ratezing does
Ratezing helps you:
- ask your customers for reviews, by email and on a review page of your own;
- follow the reviews people post about your business on sites like Google, Trustpilot or Yelp, in one place;
- receive private messages your customers choose to send you;
- plant trees: every review you get plants a tree.
We keep improving Ratezing, so features may change over time. If we remove something important you're paying for, we'll tell you first.
Your account and your team
- Keep your sign-in details safe, and tell us straight away if you think someone else is using your account.
- You can invite teammates and choose what each of them can do. You're responsible for what happens in your account, including what your teammates do.
- Agencies can manage several client businesses from one account. If you're an agency, you confirm that each client has agreed to you using Ratezing for them, and you're responsible for following these terms for all of them.
Asking for reviews honestly
Honest reviews are the point of Ratezing, and review sites, regulators and your customers expect them. When you use Ratezing, you agree to all of the following.
- You have the right to contact the people you ask. You'll only send review requests to real customers you actually served, whom you're allowed to contact about their experience, and who haven't asked you not to. You confirm this each time you send requests, and you follow the laws on contacting people that apply to you (for example, anti-spam and data protection laws).
- You ask everyone the same way. You won't pick only the customers you expect to be happy. You won't ask for a rating first and then send only happy customers to public review sites. You won't discourage anyone from leaving a negative review. Ratezing is built so every customer sees the same public review options, and you won't try to get around that.
- No fake or bought reviews. You won't write reviews about your own business, ask staff, family or friends to pose as customers, review competitors, or pay for reviews with money, discounts or gifts. The tree we plant for each review goes to the planet, not to the reviewer, and it's planted whatever the rating.
- You follow the review sites' own rules. Each site, such as Google or Yelp, has its own rules about asking for reviews. You follow them.
- Trees aren't carbon credits. You can tell your customers that every review plants a tree. You must not describe these trees as carbon offsets or carbon credits, or claim they cancel out your business's emissions.
If you break these rules, we may stop your review requests, suspend your account, or remove content, and we may have to tell a review site if it asks.
Your data and your customers' data
- Your content stays yours. Your business details, your customer lists and your customers' messages belong to you. You give us permission to use them only to run Ratezing for you.
- Your customers' information. When you upload customers or send review requests, you decide what to collect about them and why, and we handle it on your behalf, as described in our Privacy Policy. If you need a data processing agreement for your records, write to [email protected].
- Unsubscribes. When someone unsubscribes from a review request, no business on Ratezing will send them review requests again. You can't override this.
- Public reviews belong to the people who wrote them and to the sites where they're posted. We show them to you as those sites show them publicly.
Plans and payments
- Plans. Each business chooses a plan, and each of its locations gets a monthly allowance of review requests. What's included and the prices are shown when you choose. Prices don't include taxes, which you pay where they apply.
- Paying. You pay in advance, monthly or yearly, by card through our payment provider, Stripe. There's no free trial. Your subscription renews automatically until you cancel it.
- Upgrades apply straight away. You pay the difference for the rest of the current period.
- Downgrades apply from your next renewal.
- Your allowance. When a location uses up its review requests for the month, sending stops until the next month or until you upgrade. We don't charge extra without asking you.
- If a payment fails, Stripe will try again. Until it's paid, we pause sending review requests and following your reviews. Your review page stays up.
- Cancelling. You can cancel whenever you like. You keep using Ratezing until the end of the period you've paid for, and then it stops.
- Refunds. We don't refund payments, including for part of a period, except where the law requires us to.
- Price changes. If we change our prices, we'll tell you at least 30 days before your next renewal at the new price.
What you mustn't do
Don't use Ratezing to:
- break the law or anyone else's rights;
- send spam, or contact people who don't want to hear from you;
- mislead people, or pretend to be someone else;
- upload harmful software, or try to break into, overload or copy Ratezing;
- resell Ratezing, unless you're an agency using it for your own clients as described above.
Other companies' websites
Ratezing links to review sites such as Google, Trustpilot and Yelp, and reads the reviews they show publicly. We aren't part of those companies. They can change how their sites work, and they decide what's published on them. So we can't promise that a customer's review will be published or stay up, and we can't always show every review straight away.
Keeping Ratezing running
We work hard to keep Ratezing available and your information safe, but we can't promise it will never be interrupted, or that it will be free of mistakes. We sometimes need to pause it for maintenance, and we'll try to do that when it disrupts you least.
Suspending or closing accounts
- You can close your account at any time by writing to [email protected].
- We can suspend or close your account if you break these terms, if a payment isn't made, or if we have to by law. If we can, we'll warn you first and give you a chance to put things right.
- After closing, you can ask us for a copy of your data for 30 days. After that we delete it, except anything the law makes us keep. Your review page goes offline, and people you invited can no longer use your workspace.
Responsibility
- Ratezing is provided "as is". As far as the law allows, we don't give any promises about it beyond those in these terms.
- As far as the law allows, we aren't responsible for indirect losses, such as lost profits, lost business or damage to reputation, or for how review sites or your customers act.
- Our total responsibility to you for anything related to Ratezing is limited to what you paid us in the 12 months before the problem happened.
- You're responsible for how you use Ratezing, including the customers you contact and how you ask for reviews. If someone makes a claim against us because of that, you'll cover our reasonable costs.
Nothing in these terms limits anything the law says can't be limited.
Changes to these terms
If we change these terms, we'll update the date at the top. If a change matters, we'll tell you by email at least 30 days before it takes effect. If you keep using Ratezing after that, the new terms apply. If you don't agree, you can cancel before they start.
The law that applies
These terms are governed by the laws of the State of Wyoming, USA, and any dispute goes to the courts of Wyoming. If you're in a country whose laws give you rights that can't be taken away by an agreement, you keep those rights.
The whole agreement
These terms and our Privacy Policy are the whole agreement between you and us about Ratezing. If a court finds part of them unenforceable, the rest still applies. If we don't enforce something straight away, we can still enforce it later.
